The Restoration Alliance Party ("RAP", "we", "our", or "us") is committed to protecting your personal data in accordance with the Data Protection Act, 2019 (Act No. 24 of 2019) and Article 31 of the Constitution of Kenya, 2010, which guarantees the right to privacy.

This Privacy Policy explains how RAP collects, uses, and discloses personal information through its services and platforms, including websites, mobile apps, digital tools, and physical forms during party activities and interactions.

2.LEGAL BASIS FOR DATA COLLECTION AND PROCESSING

We collect and process personal data only:

1) With your explicit, freely-given, informed, and unambiguous consent, as required under Section 30 of the Data Protection Act, 2019.

2) To comply with electoral and party registration laws, including the Political Parties Act, 2011, Elections Act, 2011, and other applicable legislation.

3.WHAT DATA WE COLLECT

When you register as a member, supporter, or participant in RAP activities, we may collect:

1) Identification: Full name, national ID or passport number, date of birth.

2) Contact: Email address, phone number, postal/physical address.

3) Demographic: Gender, ethnicity, religion, special interest group (e.g., PWD, minority, marginalized community).

4) Location: County, constituency, ward, polling Centre.

5) Party Details: Membership type, subscription history, voting participation.

6) Device & Usage Data: IP address, browser/device type, website usage patterns (cookies, log files, etc.).

7) Financial: Payment details for membership or donations (where applicable).

4.HOW WE USE YOUR INFORMATION

We use your information to:

1) Register and manage your RAP membership.

2) Communicate about party activities, meetings, and events.

3) Facilitate internal party elections and democratic processes.

4) Ensure compliance with national political and electoral laws.

5) Analyze party statistics and improve strategy.

6) Enhance your experience with our digital services.

7) Process payments or donations securely.

8) Comply with legal obligations and internal audit.

5.DATA SHARING AND DISCLOSURE

We do not sell or trade your personal data. Your information may only be shared:

1) With authorized RAP officials and vetted service providers for legitimate party operations.

2) With the Office of the Registrar of Political Parties (ORPP) and electoral authorities as required by law.

3) With ICT service providers under strict confidentiality agreements.

4) When required by law, court order, or legal process.

5) To protect the rights, property, or safety of RAP or its members.

We may also share aggregated, anonymized data that cannot identify you.

6.SPECIAL INTEREST CATEGORIES

For members applying under special interest groups, you may be asked to provide:

1) Valid NCPWD number for Persons with Disabilities.

2) Proof of identity for ethnic minority or marginalized group status.

7.DATA RETENTION

We retain personal data:

1) Only as long as necessary to fulfill the purpose for which it was collected.

2) For the duration of your membership.

3) For a reasonable period thereafter, for compliance with statutory or administrative requirements.

8.YOUR RIGHTS UNDER THE DATA PROTECTION ACT, 2019

You have the right to:

1) Access your personal data

2) Correct inaccurate or outdated data

3)Request deletion (“right to be forgotten”)

4) Restrict or object to certain types of data processing

5) Request transfer of your data (data portability)

6) Withdraw consent at any time, subject to legal limitations

9.SECURITY MEASURES

We take reasonable steps to protect your data, including:

1) Encryption and secure storage of sensitive information

2) Role-based access control for party systems

3) Regular audits and system updates to prevent unauthorized access or misuse
